A spouse, family member or household member who is either the victim of domestic violence or has reasonable cause to believe that he or she is in imminent danger of becoming the victim of an act of domestic violence may file in the circuit court a sworn petition for an injunction for protection against domestic violence. Domestic violence can include any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any criminal offense resulting in physical injury or death of one family or household member by another family or household member. Family or household member includes spouses, former spouses, persons related by blood or marriage, people or are presently residing together as if a family or who have resided together in the past as if a family, and person who are parents of a child in common regardless of whether they have been married. Family or household members must be currently living together or have in the past lived together in the same single dwelling unit, except people who have a child in common.
